Right of withdrawal

This notice applies to contracts for the sale of products concluded in the online store (www.cameleontextil.com) of Kaméleon Textil Kft. (hereinafter: the Business). Under 45/2014. (II. 26.) Korm. rendelet (Government Decree on the detailed rules of contracts between consumers and businesses), the right of withdrawal is available exclusively to consumers, that is, natural persons acting outside the scope of their profession, independent occupation or business activity. Persons acting within the scope of their profession, independent occupation or business activity are not entitled to the right of withdrawal.

This notice distinguishes between three cases: the right of withdrawal (Section 2), the product exchange offered voluntarily by the Business (Section 3), and claims relating to an incorrect or defective product (Section 4). The option of a product exchange does not limit the right of withdrawal.

2. Right of withdrawal

2.1. Withdrawal period

You have the right to withdraw from the contract within 14 days without giving any reason.

The withdrawal period expires 14 days after the day on which you, or a third party other than the carrier and indicated by you, take possession of the product.

If you purchased several products in one order and receive them at different times, or if the product consists of multiple lots or pieces that arrive at different times, the withdrawal period is calculated from the day on which you take possession of the last product, lot or piece.

You may also exercise your right of withdrawal in the period between the day the contract is concluded and the day you receive the product.

2.2. Notice of withdrawal

If you wish to exercise your right of withdrawal, you must send the Business an unequivocal statement setting out your decision to withdraw. You may make the statement in any of the following ways:

  • by post, to the postal address of the Business (1097 Budapest, Soroksári út 164.);
  • by e-mail, to online@kameleontextil.hu.

You may also notify us of your intention to withdraw by phone (+36 70 451 9072); in this case, too, your statement must be unequivocal. Since it is up to you to prove that you exercised your right of withdrawal within the deadline, we recommend making your statement in writing.

You may also use the model withdrawal form at the end of this notice for your statement, but its use is not obligatory. Including your order number in the statement helps us process your request.

You exercise your right of withdrawal in time if you send your withdrawal statement before the period specified in Section 2.1. expires.

2.3. Returning the product

You must send back or hand over the product without undue delay, and in any event no later than 14 days from the day on which you communicated your withdrawal statement, to the following address:

The deadline is met if you send the product before the 14-day period has expired.

You bear the direct cost of returning the product. We are unable to accept packages sent cash on delivery.

You may enclose the completed withdrawal form or your order number in the package; this is not obligatory, but it helps identify the returned product.

2.4. Refund of the purchase price

If you withdraw from the contract, the Business will reimburse all payments received from you, including the original delivery cost, without undue delay and in any event no later than 14 days from the day on which your withdrawal statement was communicated. If you chose a type of delivery other than the least expensive standard delivery offered by the Business, we will not reimburse the resulting additional cost.

We will make the reimbursement using the same means of payment as you used for the original transaction, unless you have expressly agreed to the use of another means of payment. With your consent, the reimbursement may be made by bank transfer; in the case of in-person pickup and cash payment, a cash refund is also possible. You will not incur any additional costs as a result of the reimbursement method used.

The Business may withhold the reimbursement until it has received the product back or until you have supplied evidence of having sent it back, whichever is earlier.

2.5. Liability for diminished value

You can be held liable for any diminished value of the product only if it results from use beyond what is necessary to establish the nature, characteristics and functioning of the product.

2.6. Exception to the right of withdrawal

You may not exercise your right of withdrawal in the case of a product that is not prefabricated and was produced on the basis of your instructions or at your express request, or a product that has been clearly personalized for you (Section 29 (1) c) of Government Decree 45/2014. (II. 26.)).

3. Product exchange

If you are not satisfied with the ordered product or products, the Business voluntarily offers the option of a product exchange. This option does not limit the right of withdrawal: as a consumer, instead of an exchange, you may also withdraw from the contract under Section 2.

If you would like to exchange the product for a different color, this is possible once the unsuitable product has been returned. If you would like an exchange, please contact us in advance and let us know which color you would like.

After checking the condition of the returned product, we will carry out the requested exchange. If the requested product is not in stock, we will refund the purchase price of the product.

For an exchange for a different type of product:

  1. the existing product must be returned,

  2. and the new order must then be placed as a new purchase.

You bear the cost of returning a product sent back for exchange. We are unable to accept packages sent cash on delivery.

4. Incorrect or defective product

If we have sent you an incorrect or defective product, please contact us using the following details:

In this case, it is not a matter of withdrawal or product exchange but of defective performance: you are entitled to implied warranty rights, which are set out in detail in the chapter of the General Terms and Conditions (GTC) on implied warranty. In this case, the cost of returning the product is borne by the Business. Your implied warranty rights apply independently of your right of withdrawal.
