General Terms and Conditions

Introduction

These General Terms and Conditions (hereinafter: GTC) apply to the legal relationships established on the Business’s website www.cameleontextil.com (hereinafter: website) by accepting the GTC.

The purpose of these GTC is to set out the rights and obligations related to contracts concluded electronically through the website between the Business, as defined by the Civil Code, and the User, including the Consumer, as well as legal persons and organizations without legal personality who do not qualify as consumers, and to provide Users with information about all important facts and circumstances relating to the creation of the contract and to the provision of information society services.

Unless otherwise provided, the provisions of the GTC apply to all Users. The rights granted expressly to the Consumer (in particular the right of withdrawal, the implied warranty rules applicable to consumer contracts, the product liability warranty and the conciliation board procedure) are available exclusively to Consumers as defined by the Civil Code.

The GTC, as a contractual term, has been predetermined unilaterally by the Business for the purpose of concluding multiple contracts, without the participation of the User, and its content has not been individually negotiated by the Business and the other party using the services of the website.

The products available for purchase through the website are available to those who have reviewed and accepted the content of the GTC before concluding the contract.

The subjects of the rights and obligations set out in the GTC and their definitions are as follows:

  • Business: a person acting within the scope of their profession, independent occupation or business activity.
  • User: a natural person, legal person or organization without legal personality who/which uses an information society service.
  • Consumer: a natural person acting outside the scope of their profession, independent occupation or business activity.

The content of these GTC has been prepared in accordance with the applicable legislation, in particular:

  • Act CLV of 1997 on consumer protection,
  • Act CVIII of 2001 on certain issues of electronic commerce services and information society services,
  • Act V of 2013 on the Civil Code,
  • Government Decree 45/2014 (II. 26.) on the detailed rules of contracts between consumers and businesses,
  • Government Decree 373/2021 (VI. 30.) on the detailed rules of contracts between consumers and businesses for the sale of goods and for the supply of digital content and digital services,
  • NGM Decree 19/2014 (IV. 29.) on the procedural rules for handling warranty and guarantee claims relating to goods sold under contracts between consumers and businesses, and
  • Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, GDPR).

Please read the content of the GTC carefully before placing an order on the website!

General provisions

Language of the contract

The language of these General Terms and Conditions, the website, administration and complaint handling is Hungarian.

Form of the contract, filing and subsequent accessibility

From a legal point of view, orders placed on the website (electronic order forms) do not qualify as written contracts. The Business does not individually file the contract concluded with the User, but records the date of conclusion of the contract; the details of the contract are contained in the order confirmation.

The text of the GTC is available at any time on the GTC page of the website, from where it can be saved and printed. The Business provides the GTC with its effective date and, in the event of amendment, publishes the amended GTC on the website. The amended GTC applies to orders placed after its publication; the amendment does not affect contracts already concluded.

Code of conduct

The Business has not joined any code of conduct under the law on the prohibition of unfair commercial practices against consumers; therefore, no code of conduct is available in relation to the commercial practices of this website.

Operation of digital content and interoperability with hardware and software

The website uses the HTTPS protocol to display web documents to the User over the Internet on its HTML-format website.

The images, graphic elements and other data transmitted in this manner (based on the HTTPS protocol) are accessible and displayable through any modern browser (the currently latest versions of known browsers) on any device capable of running such browsers.

In order to ensure an appropriate user experience, the User must ensure that, in addition to using a suitable browser, an Internet connection of adequate speed is available.

Purchasing on the website presupposes that the User is aware of the technical and technological limitations of the Internet and accepts the possibility of errors associated with its use.

The Business is not liable for faulty transmission of data over the Internet or for Internet-related operational errors that prevent smooth purchasing, provided that they arose from a cause outside the Business’s sphere of interest.

Digital content and applicable technical protection measures

Use of the website does not pose a risk to the User’s computer; however, the Business recommends that the User use antivirus software and install security updates for the operating system. Protecting the data stored on the User’s computer is the User’s responsibility.

Anyone may place a link to the website on their own website without the Business’s separate consent. It is prohibited to place a link in such a way that the website appears as part of another website.

Products available for purchase

Products available for purchase on the website

The Business provides detailed information on the website about the name of the product and the essential characteristics of the products, including the price, and, where necessary, the unit price and additional costs (especially costs charged for delivery and packaging), and displays the photo(s) of the product. The images shown on the product pages may in some cases differ from reality and may serve as illustrations.

The prices displayed for the products are understood in the currency shown on the website (in forints on the Hungarian-language site and in euros on all other language versions); they include the VAT prescribed by law and the packaging cost, but do not include the home delivery fee and, in the case of cash-on-delivery payment, the cash-handling fee, which are payable in addition to the gross price.

If a promotional price is displayed, the Business fully informs the User about the promotion and its parameters.

General order of purchasing

Orders may be placed through the website 24 hours a day, with or without registration (as a guest).

Making a contractual declaration aimed at ordering a product (acceptance of the GTC) always entails a payment obligation!

Process of concluding the contract

Steps and technical conditions of concluding the contract

  • The product to be purchased can be placed in the cart using the add-to-cart button on the product page. Some products are available with several parameters; in such cases the desired variant (for example, the color) must be selected, and then the desired quantity must be entered according to the unit of measure specified for the given product. Several units of a product may be purchased at the same time.
  • The cart can be opened at any time during the purchasing process using the cart icon on the website. In the cart, the quantities of the products can be modified and products can be deleted from the cart.
  • The User may continue shopping at any time until the order is submitted and may place further products in the cart.
  • Registered Users may place orders after logging in; orders may also be placed without registration, as a guest. An already registered User can log in with their e-mail address and password. If the User has not yet registered, they can create a user account by completing the registration form or continue the order as a guest.
  • During the order process, the User enters or checks the billing and shipping details; if delivery is requested to an address different from the billing address, a different shipping address can be provided. For logged-in Users, the previously provided details appear automatically and do not need to be entered again; however, if there has been a change, the details can be modified.
  • The User then selects the shipping method and the payment method. Further information about the selected payment method is displayed upon selection.
  • Before the order is submitted, the order details can be reviewed again in the summary, including the name and quantity of the goods ordered, their gross amount (subtotal), the shipping fee and the total gross amount payable. If the User wishes to modify the order, they may return to the cart and correct it there.
  • To submit the order, the User must accept the GTC and declare that they have read the Privacy Policy.
  • To close the order, the User must click the button for submitting the order.
  • After the order has been submitted, the order is confirmed on the website, where the User who placed the order can review the order-related data once again. The User pays the consideration for the order according to the chosen payment method (see: Payment).
  • After submitting the order, the User receives confirmation of the contract by the Business by e-mail without delay, but no later than within 48 hours (hereinafter: confirmation). The confirmation contains the name of the purchased product, its unit of measure, quantity, unit price, total value, the chosen payment method and the shipping cost (in the case of cash-on-delivery payment, also the cash-on-delivery handling fee), as well as a link to the Right of Withdrawal notice and to the model withdrawal form.
  • The data of the concluded contract are final and therefore cannot be modified by the User after submission.
  • If the confirmation is not received by the User within the prescribed deadline, the User is released from the offer commitment or contractual obligation. The order and its confirmation are deemed to have arrived at the Business and at the User when they become accessible to them. The Business excludes its liability for confirmation if the confirmation does not arrive on time because the User provided an incorrect e-mail address during the order process, or because the storage space of the User’s e-mail account is full and cannot receive messages.
  • Orders are processed on business days between 10:00 and 16:00.
  • If, during processing, it becomes clear that the order cannot be fulfilled, the Business rejects the order and sends notification of this and of the reason for rejection to the e-mail address provided by the User. After rejection, the User may place a new order on the website.
  • If the Business fails to perform its contractual obligation because the product specified in the contract is not available, the Business shall immediately inform the User thereof, and the Business shall refund the amount paid by the User without delay, but no later than within thirty days. Fulfillment of this obligation does not exempt the Business from other consequences of breach of contract.
  • The User qualifying as a Consumer may, where possible in relation to the purchased product, exercise the right of withdrawal under the withdrawal rules.

Correction of data entry errors

The goods placed in the cart and the parameters selectable during the order process (especially type and quantity) may be modified if necessary. The User can modify the entered data after entering the cart, at any time during the purchasing process before submitting (activating) the order, and also on the final review page of the order process.

In addition, the Business ensures that data entry errors can be recognized by displaying an error message in the case of incomplete or incorrect data entry (inappropriate characters).

Payment, shipping, fulfillment deadline and delivery

Payment

Cash on delivery

Cash on delivery is available only for delivery addresses in Hungary. You may choose to pay the total amount of the product and the shipping fee in cash personally to the courier at the same time as receiving the goods during courier delivery of the ordered product within Hungary.

Cash or bank card payment in our store

You have the option to pay the price of the product in cash or by bank card in our store.

Advance bank transfer

We send an invoice copy by e-mail, on the basis of which the bank transfer can be made. After the purchase price has been received in our account, the ordered goods may be collected at our premises or delivered. The original copy of the invoice is handed over together with the goods.

Online payment

When finalizing your order, you may pay online by bank card, Google Pay or Apple Pay on the secure payment page of the payment service provider Worldline. The card and payment data are processed by Worldline and do not reach the Business.

For all payment methods, payment is made in the currency shown on the website (in forints on the Hungarian-language site and in euros on all other language versions).

Performance deadline

In the case of product sales, the Business fulfills its obligation to deliver the product within 2-4 business days, provided that the ordered product is in stock.

The performance deadline for orders of products stored in the Business’s external warehouse is 1-2 weeks. In our confirmation – by telephone or e-mail – (not in the automatic confirmation) we provide precise information about the expected delivery time and circumstances of the ordered products.

Shipping

In the case of product delivery, the package contains the ordered product.

The invoice issued for the order accompanies the goods or is sent electronically.

Packages are delivered on business days between 8 and 17 o’clock.

Delivery/shipping fee: Weight-based settlement with GLS partner company.

Delivery in the case of product purchase

Delivery means handing over the goods to the User. If the User cannot arrange receipt of the goods within the period specified in the confirmation by the Business, the User may designate another adult person in writing (by e-mail) after the confirmation as a person authorized to receive the goods on their behalf.

If the delivery address or the note related to receipt is unclear, the Business contacts the User by telephone. In such cases, delivery is arranged only after the data necessary for delivery have been clarified following the above consultations.

Please inspect the package in the presence of the courier upon delivery, and if any damage is detected on the product or the packaging, request that a report be drawn up; in the event of damage, you are not obliged to accept the package. The report facilitates the later handling of the matter; however, its absence does not limit implied warranty rights.

Delivery obstacle and its financial consequences

A delivery obstacle occurs if neither the User nor (if applicable) the person authorized to receive the goods is present at the specified delivery location and time within the time interval indicated in the confirmation. In such a case, the Business or its shipping partner attempts to contact the User – first on site, by telephone in the absence of an immediate response, and then at the provided e-mail address – in order to agree on a new place and time for delivery. If contact cannot be established, the Business is entitled to withdraw from the contract, of which it sends written notification to the User at the e-mail address provided by the User.

If the obstacle to delivery is that the person designated by the User as authorized to receive the goods has not yet reached the age of 18, or this cannot be established with complete certainty, the Business or its parcel delivery agent attempts further consultation with the User as set out above, and if this is unsuccessful, withdraws from the contract.

The delivery obstacles set out above are considered events attributable to the User’s conduct or occurring within the User’s sphere of interest; therefore, in the event of withdrawal, the Business is entitled to the delivery fee.

Right of withdrawal from the purchase in the case of Users qualifying as Consumers

The Consumer has the right to withdraw from the contract within 14 days without giving any reason. The detailed rules of withdrawal and the model withdrawal form are contained in the Right of Withdrawal notice published on the website.

Withdrawal deadline
In the case of a contract for the sale of a product, the deadline expires after 14 days from the day on which the Consumer or a third party designated by the Consumer, other than the carrier, takes delivery of the product. In the case of the sale of several products, if the individual products are delivered at different times, the deadline is calculated from the day on which the last product delivered is received.

If the Consumer wishes to exercise the right of withdrawal, the Consumer sends a clear statement of the intention to withdraw to the Business by post, by e-mail or by telephone. For this purpose, the Consumer may also use the model withdrawal form published in the Right of Withdrawal notice.

The Consumer exercises the right of withdrawal within the deadline if the Consumer sends the withdrawal statement before the expiry of the above deadline.

Legal effects of withdrawal
If the Consumer withdraws from the contract, the Business shall reimburse all consideration paid by the Consumer without delay, but no later than within 14 days from the communication of the withdrawal, including the shipping costs (except for additional costs arising from the Consumer’s choice of a shipping method other than the least expensive standard shipping method offered by the Business). The Business uses the same payment method for the reimbursement as was used in the original transaction, unless the Consumer expressly consents to the use of another payment method; the Consumer shall not incur any additional costs as a result of this method of reimbursement.

In the case of a contract for the sale of a product, the Business may withhold reimbursement until it has received the product back or until the Consumer has provided proof that the product has been returned (the Business takes the earlier of the two dates into account).

The Consumer is obliged to return or hand over the product to the Business without undue delay, but no later than within 14 days from communicating the withdrawal statement. The deadline is deemed to have been met if the Consumer sends the product before the expiry of the 14-day deadline.

The direct cost of returning the product is borne by the Consumer.

The Consumer may be held liable for any decrease in the value of the product only if it results from use exceeding the use necessary to establish the nature, characteristics and functioning of the product.

The Consumer may not exercise the right of withdrawal in the case of a non-prefabricated product made on the basis of the Consumer’s instructions or at the Consumer’s express request, or in the case of a product clearly personalized for the Consumer.

The right of withdrawal does not apply to a User who does not qualify as a Consumer, that is, to a person acting within the scope of their profession, independent occupation or business activity.

Guarantee

Government Decree 151/2003 (IX. 22.) on mandatory guarantees for certain durable consumer goods does not apply to the products distributed by the Business (textile fabrics by the meter); therefore, no mandatory guarantee applies to the products. In the event of a defect in the product, the Consumer is entitled to the implied warranty and product liability warranty rights described in the GTC.

Implied warranty rights of the User

Implied warranty means that the Business (the seller of the product) bears implied warranty liability for the defect of the product (more precisely, for a defect resulting from a cause already existing in the product at the time of performance).

Within the scope of implied warranty, the User is obliged to prove that the cause of the defect already existed in the product at the time of performance and that the defect was not caused by improper use. In the case of a consumer contract, however, as an exception to the main rule, in the case of a defect discovered within 1 year from performance, it must be presumed that the defect already existed at the time of performance, unless this presumption is incompatible with the nature of the product or the nature of the defect. This presumption does not apply to a User who does not qualify as a Consumer.

The Business’s implied warranty liability is objective, meaning it is independent of whether the Business knew that it had sold a product affected by a defect (more precisely, by a defect cause).

The Consumer is obliged to notify the defect without delay after discovering it. A defect notified within 2 months from its discovery shall be deemed to have been notified without delay.

Implied warranty rights
The Consumer may, at their choice, exercise the following implied warranty claims:
  • may request repair or replacement, unless fulfillment of the chosen implied warranty right is impossible, or unless it would result in disproportionate additional costs for the Business compared with fulfillment of the other implied warranty claim, taking into account the value represented by the service in flawless condition, the gravity of the breach of contract, and the harm caused to the entitled party by fulfillment of the implied warranty right; or
  • may request a proportionate reduction of the consideration or may withdraw from the contract if repair or replacement is impossible or disproportionate, the Business has not undertaken repair or replacement or has not performed it within an appropriate deadline without significant inconvenience to the Consumer, the defect has reappeared despite repair or replacement, the defect is so serious that it justifies an immediate price reduction or withdrawal, or the Consumer’s interest in repair or replacement has ceased. Withdrawal is not possible on account of an insignificant defect.

The Consumer may switch from the chosen implied warranty right to another; however, the Consumer bears the cost of switching unless it was justified or caused by the Business.

The Consumer’s implied warranty claim becomes time-barred 2 years after performance; after the limitation period has expired, implied warranty rights may no longer be enforced. For a User who does not qualify as a Consumer, the general rules of the Civil Code apply (the limitation period is 1 year from performance).

When enforcing an implied warranty claim, the Consumer must prove the conclusion of the contract. If the Business disputes the conclusion of the contract, it draws the Consumer’s attention to the possibility of making a complaint and to the method of complaint handling.

The Business considers the conclusion of the contract proven if the Consumer presents the document proving payment of the consideration – an invoice or receipt issued under the Value Added Tax Act.

The Business records consumer objections (notification of implied warranty claims) in minutes in accordance with NGM Decree 19/2014 (IV. 29.) on the procedural rules for handling warranty and guarantee claims relating to goods sold under contracts between consumers and businesses.

Product liability warranty rights for Consumers

Under the product liability warranty, the manufacturer is directly liable for the defect of a defective movable item, but exclusively to the Consumer.

In the case of product liability warranty, a product is defective if, at the time it was placed on the market (when the specific product leaves the manufacturer’s control, and not when the product type appeared on the market), it does not meet the quality requirements in force or does not have the characteristics described by the manufacturer.

The manufacturer is liable under the product liability warranty for two years from the date the product is placed on the market. This enforcement deadline differs from the implied warranty deadline in that it is not a limitation period but a forfeiture period, meaning that after it expires, no product liability warranty claim may be enforced.

Rights arising from the product liability warranty pass to the new owner in the event of a change of ownership.

The Consumer may exercise a product liability warranty claim only against the manufacturer or distributor of the movable item. In the case of enforcing a product liability warranty claim, the Consumer must prove the defect of the product.

The Consumer may primarily request repair from the manufacturer. If repair is not possible within an appropriate deadline or without prejudice to the Consumer’s interests, the Consumer may request replacement. Monetary remedies, price reduction and withdrawal are therefore not available, since no contract has been concluded between the manufacturer and the Consumer, and therefore no “money transfer” or withdrawal from a contract can take place.

The manufacturer (distributor) is released from its product liability warranty obligation only if it can prove that:

  • it did not manufacture or place the product on the market within the scope of its business activity, or
  • the defect was not recognizable according to the state of scientific and technical knowledge at the time the product was placed on the market, or
  • the defect of the product resulted from the application of legislation or a mandatory official regulation.

For release from liability, it is sufficient for the manufacturer (distributor) to prove one reason.

Complaint handling

First, contact the business with your complaint (the business’s complaint handling method)

The Business strives to resolve complaints arising from Consumers “in-house” and to remedy them as soon as possible to the Consumer’s satisfaction.

The Consumer may communicate to the Business, orally or in writing, any complaint relating to the conduct, activity or omission of the Business, or a person acting in the interest or on behalf of the Business, directly connected with the distribution or sale of goods to consumers.

Handling oral complaints

The Business immediately examines any oral complaint received and remedies it if necessary. If the Consumer does not agree with the handling of the complaint, or immediate investigation of the complaint is not possible, the Business takes minutes of the complaint and of its position relating to it, and a copy of the minutes

  • a) in the case of an oral complaint communicated in person, is handed over to the Consumer on the spot,
  • b) in the case of an oral complaint communicated by telephone or using another electronic communications service, is sent to the Consumer no later than together with the substantive response.

The Business responds to the complaint in writing and on the merits within thirty days from its receipt; if it rejects the complaint, it gives reasons for its rejecting position.

The minutes taken of the complaint contain the following:

  • a) the Consumer’s name and address,
  • b) the place, time and method of submitting the complaint,
  • c) a detailed description of the Consumer’s complaint and a list of documents and other evidence presented by the Consumer,
  • d) the Business’s statement on its position regarding the Consumer’s complaint, if immediate investigation of the complaint is possible,
  • e) the signature of the person taking the minutes and – except in the case of an oral complaint communicated by telephone or using another electronic communications service – the Consumer’s signature,
  • f) the place and time of taking the minutes,
  • g) in the case of an oral complaint communicated by telephone or using another electronic communications service, the unique identification number of the complaint.

In the case of notification of an implied warranty claim, the Business also takes the minutes in accordance with NGM Decree 19/2014 (IV. 29.) (see: Implied warranty rights).

In the case of a written complaint

The Business responds in writing to a written complaint received by the Business within thirty days from receipt and sends the response to the Consumer at the same time; if the complaint is rejected, the response also contains the reasons for rejection.

In the event of rejection of the complaint – whether oral or written – the Business informs the Consumer in writing, in addition to its rejecting position and the reasons therefor, about which authority or conciliation board procedure may be initiated with the complaint, depending on its nature. The information also includes the seat, telephone and Internet contact details, and mailing address of the competent authority or of the conciliation board according to the consumer’s place of residence or stay. The information also covers whether the business uses the conciliation board procedure for the purpose of resolving the consumer dispute.

The Business keeps the minutes taken of the complaint and a copy of the response for three years and presents them to the inspection authorities upon request.

The Business receives consumer complaints at the following contact details:

Complaint handling with the involvement of the Conciliation Board

The Consumer may turn to a conciliation board for the out-of-court settlement of a consumer dispute that has arisen with the Business. The Business is obliged to cooperate in the conciliation board procedure: at the request of the conciliation board, it sends a statement of defense and ensures the participation at the hearing of a person authorized to reach a settlement.

The purpose of the Board’s procedure is to close disputes arising between consumers and business organizations, that is businesses, by settlement between the parties. If no settlement is reached, the Conciliation Board decides the matter by its decision, taking into account the fast, effective and simple enforcement of consumer rights.

The conciliation board has competence for out-of-court resolution of consumer disputes relating to goods and services

  • quality and safety,
  • and the application of product liability rules,
  • as well as the conclusion and performance of contracts

through out-of-court settlement of related consumer disputes.

This means that if a service provided under either a sales contract or a business contract does not comply with the law or with the contract, the buyer or customer may turn to the Conciliation Board. It is important that conciliation may be initiated only by the consumer as a private individual.

The Consumer may also turn to the conciliation board competent according to their place of residence or stay.

As a last resort, contact the Authority

If your complaint has not been remedied by either the Business or the conciliation board, you may initiate a consumer protection authority procedure. In consumer protection authority matters, the county government office or the Budapest Capital Government Office acts, at first instance through the district office. From January 1, 2025, the professional direction of the consumer protection authorities is provided by the National Trade and Consumer Protection Authority (Nemzeti Kereskedelmi és Fogyasztóvédelmi Hatóság, NKFH).

The competent government office or district office can be searched for at the following link:

https://kormanyhivatalok.hu/

And, if no other solution remains, as the very last resort, turn to Court

If the above procedures do not lead to a result, you may turn to the Court competent according to your place of residence in order to establish the fact of breach of contract and the validity of the warranty claim.

Data protection

For the purpose of creating, determining the content of, modifying and monitoring the performance of the contract aimed at providing information society services, invoicing the fees arising therefrom, and enforcing related claims, the Business may, on the basis of law and without the Consumer’s consent, process the natural personal identification data and address necessary for identifying the Consumer.

The Business processes the personal data provided by the User exclusively in accordance with the content set out in the Privacy Policy.

The current version of the Privacy Policy is available at all times on the website, on the Privacy Policy page.

Term of the contract

These GTC enter into force on October 15, 2026.

These GTC remain in force until the date of publication of the amended GTC. Each contract is governed by the GTC in force at the time the order was placed.

Final provisions

The Business is entitled to amend the GTC unilaterally. The amendment applies to orders placed after its publication and does not affect contracts already concluded.

It is prohibited to download, electronically store (except for downloading and storing the GTC and the information notices published on the website exclusively for personal purposes), process or sell the content appearing on the website or any part thereof without the written consent of the Business.

If any part of these GTC becomes invalid, unlawful or unenforceable, this shall not affect the validity, legality and enforceability of the remaining parts.

If the Business does not exercise a right to which it is entitled under the GTC, failure to exercise the right shall not be deemed a waiver of that right. Any waiver of any right is valid only in the case of an express written declaration to that effect. The fact that the Business does not insist strictly on an essential term or provision of the GTC on one occasion does not mean that it waives the right to insist on strict compliance with that term or provision in the future.

Hungarian law shall govern matters not regulated in these GTC and the interpretation of these GTC. The mandatory provisions of the applicable laws shall apply to the parties without any separate stipulation.
